Steps to reproduce:
1. Start off with a fresh instance of JOSM.
2. Download a small area of data from the OSM server.
3. Delete the ""layer"" that was created when you downloaded the data.
4. You should be back on the Welcome Page again.
5. Now, download the same small area of data again from the OSM server.

The bug mentioned above now shows up.
