Steps to reproduce:

 1. Start JOSM
 1. Create a new data layer (CTRL+N)
 1. Draw a way
 1. Create another data layer (CTRL+N)
 1. Switch back to the first layer
 1. Make sure that the way is selected
 1. Press CTRL+C followed by CTRL+V -> No effect

However: Copy/Pasting via the 'Edit' menu still works...
