I've sent them an e-mail about this problem and got the response today:

So what do we do?
* Nothing and just ignore the error in IntegrationTestIgnores > Users are presented the imagery in JOSM imagery menu but will get errors if not using a Polish Internet connection
* Update Maps XML schema to describe this restriction and then display a meaningful error when a user outside of Poland tries to use this imagery layer
